I only recently understood how unfair and financially debilitating the massive ruling of Judge Engoron against Trump in a New York court truly is. In addition to the more than 350 million dollars in fines, the Judge imposed another 100 million in interest, a total of almost half a billion dollars. To make matters worse, under some insane New York law Trump will have to place that amount of money in escrow before appealing to a higher New York court.
This is madness. Where is the fraud? No one is claiming that they lost money to the Trump organization. Those whom he is accused of defrauding are anxious to do more business with him.
In a previous post I stated my opinion that Trump had grounds for an immediate appeal to the United States Supreme Court under the equal protection clause of the Fourteenth Amendment. More recently, distinguished law professor Jonathan Turley wrote that New York appears to be violating the Eighth Amendment, which states that “Excessive bail shall not be required, nor excessive fines imposed, nor cruel and unusual punishments inflicted.”
Love him or hate him, I believe that all of us can agree that certain courts have singled Trump out for cruel and unusual prosecutions and excessive fines; and in their war against Trump these radical prosecutors and judges are laying waste to the American legal system.
